Resumen

Daniela, estudiante de licenciatura en Enfermería y vinculada laboralmente como enfermera en una sala de cuidados intensivos de un hospital, accede al Servicio de Orientación Jurídica (SOJ) del Centro Nacional de Educación Sexual (CENESEX) por sentirse discriminada en el ámbito laboral y escolar a causa de su identidad de género. Como parte del proceso de atención, se advierten violaciones a sus derechos sexuales, así como a otros derechos fundamentales regulados en el texto constitucional cubano. El caso fue resuelto por vía administrativa, luego de derivar el asunto al conocimiento del Ministro de Salud Pública.

Abstract

Daniela is a student of Nursing and works as a nurse in the intensive care service of a hospital. She went to the Legal Advice Service at the National Center for Sexual Education (CENESEX) because she felt discriminated at workplace and at school because of their gender identity. As part of the care process, sexual rights violations were noted, as well as other fundamental rights regulated in the Cuban Constitution. The Ministry of Public Health had a thorough knowledge of the case, which was settled by administrative ways.
